Regulations for the Protection of Submarine Cable Pipelines

Article 1: In order to strengthen the protection of submarine cable pipelines, ensure their safe operation, and safeguard the legitimate rights and interests of their owners, these Regulations are formulated in accordance with the "Regulations on the Administration of Laying Submarine Cable Pipelines" and relevant laws and regulations.
Article 2: This Regulation applies to the protection activities concerning submarine cables and pipelines located in the internal waters, territorial sea, continental shelf, and other maritime areas under the jurisdiction of the People’s Republic of China.
The protection activities for military cable ducts are not subject to these regulations.
Article 3: The marine administrative authority under the State Council is responsible for the protection of submarine cable and pipeline systems nationwide.
The marine administrative departments of local people's governments at or above the county level along the coast are responsible for protecting submarine cable and pipeline systems in the waters adjacent to their administrative regions.
Article 4: Any organization and individual has the obligation to protect submarine cable and pipeline systems, and is entitled to report and bring charges against any acts that damage such systems.
Article 5: Within 90 days after the completion of the laying of a submarine cable pipeline, the owner of the pipeline shall submit to the marine administrative authority of the people's government at or above the county level for filing the registration documents, including the route map and location table of the submarine cable pipeline, and simultaneously send a copy to the maritime administration authority.
Submarine cable pipelines that were completed and laid before the promulgation and entry into force of these regulations shall, within 90 days after the effective date of these regulations, be filed in accordance with the provisions of the preceding paragraph.
Article 6: The marine administrative departments of people's governments at or above the provincial level shall annually publish a notice on submarine cable and pipeline routes to the public.
The subsea cable pipeline announcement includes the name, number, registration number, owner of the subsea cable pipeline, intended use, total length (in kilometers), start and end points of the route (latitude and longitude), schematic diagram, and identification markings.
Article 7: The State shall implement a protection zone system for submarine cable and pipeline facilities.
The marine administrative departments of the people's governments at or above the provincial level shall, based on the filed registration records, coordinate with relevant departments at the same level to delineate protection zones for submarine cable and pipeline routes, and publicly announce these zones to the public.
The scope of the submarine cable pipeline protection zone shall be determined in accordance with the following provisions:
(1) In the wide coastal waters, the area extends 500 meters on either side of the submarine cable pipeline.
(2) For narrow sea areas such as bays, the protection zone extends 100 meters on either side of the submarine cable pipeline.
(3) Within the harbor area, 50 meters on either side of submarine cable pipelines.
After the demarcation of the submarine cable pipeline protection zone, it shall be reported to the marine administrative authority under the State Council for record.
Article 8: It is prohibited to engage in sand dredging, drilling, piling, anchoring, dragging anchors, bottom trawling, netting, aquaculture, or any other maritime operations within the protection zone of submarine cable and pipeline systems that could potentially compromise the safety of these cables and pipelines.
Article 9: The marine administrative departments of the people's governments at or above the county level have the authority, in accordance with relevant laws, regulations, and these Provisions, to conduct regular patrol inspections of submarine cable and pipeline protection zones; and they have the authority to stop any acts that violate these Provisions.
Article 10: The State encourages owners of submarine cable and pipeline systems to set up markers for protection zones and along the routes of such cables and pipelines.
The owner of an undersea cable pipeline who sets up markers shall file a record with the marine administrative authority of the people's government at or above the county level.
